2004 Session - Partial List of Bills That Advance the Cause of Equality for LGBT Californians

AB 1520 (Kehoe) - California Veterans Memorial Commission (formerly the LGBT Veterans Memorial Commission): Establish within the California Dept. of Veterans Affairs the California Veterans Memorial Commission that would have the authority to approve requests for veterans memorial.
Status: Hearing Date: Tue., Apr. 13, Senate Veterans Affairs Committee

AB 1967 (Leno) - Marriage License Non-Discrimination Act: Prohibit discrimination by the State of California in the issuance of marriage licenses to same-sex couples.  Provide that marriage is a personal relation arising out of a civil contract between 2 persons.
Sponsor: Equality California (EQCA)
Status: Introduced on Feb. 12.  Eligible to be heard in committee after Mar. 13.

AB 2208 (Kehoe) - California Insurance Equality Act: Require California insurance companies, i.e., health, homeowners, automobile, life, etc., to provide equal coverage for domestic partners and spouses.
Sponsors: Equality California (EQCA) and California Insurance Commissioner John Garamendi
Status: Introduced on Feb. 19.  Eligible to be heard in committee after Mar. 19.

AB 2580 (Goldberg) - Domestic Partner Technical Clean-up Bill (Spot Bill)
Status: Introduced on Feb. 20.  Eligible to heard in committee after Mar. 22.

AB 2889 (Laird) - Employment Anti-Harassment Bill: Clarify language in the Fair Employment and Housing Act (FEHA) to ensure that under state law employers may potentially be liable for any types of harassment under the enumerated bases, i.e., sex, gender, religion, race, ethnicity, national origin, disability, etc., committed against their workers by clients, customers and other third parties if they knew or should have known of the harassment, and failed to take immediate and appropriate corrective action to stop the harassment.
Status: Introduced on Feb. 20.  Eligible to be heard in committee after Mar. 22.

AB 2900 (Laird) - Omnibus Labor & Employment Non-Discrimination Bill: Amend various labor and employment anti-discrimination provisions of the California Codes, i.e., Unemployment Insurance Code Sec. 1256.2, Education Code Sec. 45293, Gov. Code Sec. 19702, Labor Code Sec. 1735, etc., to be consistent with the Fair Employment and Housing Act's enumerated bases.

Status: Introduced on Feb. 20.  Eligible to be heard in committee after Mar. 22.

AJR 60 (Lieber) - Joint resolution supporting the federal Permanent Partners Immigration Act (PPIA).
Sponsor: Equality California (EQCA)
Status: Referred to Assembly Judiciary Committee.

AJR XX (Leno) - Joint resolution opposing the discriminatory federal marriage amendment to the U.S. Constitution.
Sponsor: Equality California (EQCA)
Status: To be introduced.

SB 1234 (Kuehl) - Omnibus Hate Crimes Bill (Spot Bill)
Status: Introduced on Feb. 12.  May be acted upon on or after Mar. 14.


2003 Session: LGBT Caucus Legislative Priorities

AB 17 (Kehoe) - Equal Benefits in State Contracts:
Prohibit a state agency from entering into a contract worth $100,000 or more with businesses that discriminate in providing employment benefits between an employee with a spouse and an employee with a registered domestic partner.  [Fact Sheet]

Status – Passed the California Legislature and approved by Governor Gray Davis.
(Chapter 752, Statutes of 2003) - Effective Date: January 1, 2007

AB 196 (Leno) - Gender Nondiscrimination Bill: Prohibit gender-based discrimination in employment and housing.
Sponsor – Equality California (formerly CAPE)
Status – Passed the California Legislature and approved by Governor Gray Davis. (Chapter 164, Statutes of 2003) - Effective Date: January 1, 2004

AB 205 (Goldberg) – Domestic Partner Rights and Responsibilities Act of 2003: Expand significantly the rights and responsibilities currently provided to registered domestic partners and their families to include nearly all the legal rights, benefits, responsibilities, duties, and obligations under state law currently available only to married couples.  [Fact Sheet]

Status – Passed the California Legislature and approved by Governor Gray Davis.
(Chapter 421, Statutes of 2003) - Effective Date: January 1, 2005

AB 458 (Chu) - Foster Care Anti-Discrimination Act of 2003: Extend the rights of a foster child to have fair and equal access to all services, placement, care, treatment, and benefits, and to not be subjected to discrimination or harassment on the basis of actual or perceived race, ethnic group identification, ancestry, national origin, color, religion, sex, sexual orientation, gender identity, or mental or physical disability. This bill would also require training for administrators, licensing personnel, licensed foster parents, and relative caretakers to include training about this right.
