AB 1479, as it passed the Assembly, authorized the Board of Supervisors of the County of Madera to transfer the duties of the county road commissioner to the county director of the department of public works.

The Senate amendments also authorize the Board of Supervisors of the County of Tehama to transfer the duties of the county road commissioner to the county director of the department of public works.

AB 87, as it passed the Assembly, prohibited an incentive or concession granted pursuant to the Density Bonus Law for a mixed-use development containing a hotel, motel, bed and breakfast inn, or other visitor-serving purpose from applying to the portion of the proposed development containing hotel, motel, bed and breakfast inn, or other visitor-serving purpose use. AB 87, as it passed the Assembly, made various technical changes to the Density Bonus Law and updated various cross-references to that law in other provisions.

The Senate amendments instead specify that certain provisions of the Density Bonus Law do not require a city, county, or city and county to approve, grant a concession or incentive requiring approval of, or waive or reduce development standards otherwise applicable to transient lodging as part of a housing development, except as specified. The Senate amendments remove the technical and conforming changes described above and make nonsubstantive changes to address chaptering conflicts with SB 92.

AB 391, as it passed the Assembly, revised a requirement that notices required by the Mobilehome Residency Law be delivered to the homeowner of the mobilehome park. Specifically, AB 391, as it passed the Assembly, authorized those notices to be delivered either to the homeowner or the resident of the mobilehome, except as specified. Additionally, AB 391, as it passed the Assembly, authorized certain of those notices to be delivered by electronic communication, if the homeowner or resident provides their voluntary, written consent, as provided.

The Senate amendments instead require that all notices required by the Mobilehome Residency Law be delivered to both the homeowner and resident. The Senate amendments allow certain notices to be delivered by electronic mail if the homeowner or resident has provided affirmative, written consent, as defined, and make nonsubstantive changes reflective of existing law to further specify which notices may be delivered by electronic mail. The Senate amendments additionally allow a homeowner or resident to revoke consent for delivery by electronic mail at any time, as specified. The Senate amendments also require management to deliver a notice to the homeowner or resident stating that they have agreed to receive notices by electronic mail and may revoke this agreement.

AB 414, as it passed the Assembly, required a landlord, if they received a security or rental payments from a tenant electronically, to return the remainder of the security electronically to a bank account or other financial institution designated by the tenant or by any electronic or virtual method available to the landlord, unless the landlord and tenant designated another method of return by written agreement.

The Senate amendments require that the bank account or other financial institution be designated by the tenant in writing. With respect to a return of a security to any electronic or virtual method available to the landlord, the Senate amendments require the landlord to obtain agreement by the tenant in writing. The Senate amendments additionally require the landlord to notify the tenant in writing of the tenant’s right to receive the security electronically pursuant to these provisions, as specified, if the landlord received the security or rental payments from the tenant electronically.

AB 414, as it passed the Assembly, if multiple adult tenants reside in a unit, required the landlord to return the remainder of the security by a check made payable to all adult tenants, as specified, and furnish the itemized statement by first class mail, postage prepaid, to any one of the adult tenants chosen by the landlord, unless the landlord and all adult tenants, at the commencement of the tenancy or at any time during or after the tenancy, enter into a mutual agreement containing specified provisions.

The Senate amendments additionally authorize the landlord to furnish the itemized statement by personal delivery, and require the mutual agreement regarding the return of the remainder of a security among multiple adult tenants be written. The Senate amendments, if the tenant terminates the lease for a specified reason, there is no mutual agreement, and the tenant requests that the security be disbursed in another manner, authorize the landlord to return the security in a manner other than by check made payable to all adult tenants.

AB 482, as it passed the Assembly, among other things, required the California Table Grape Commission, upon the suspension of its operations, to post on a public bulletin board, to be maintained by the secretary of their office, a copy of the notice of suspension of operations, and to publish the notice in a newspaper of general circulation in each district. AB 482, as it passed the Assembly, required the California Table Grape Commissioner to mail a copy of the notice of suspension to all producers and shippers affected by the suspension, as specified.

The Senate amendments instead require that the notice of suspension be posted on the department’s website, rather than on the public bulletin board and in a newspaper, as specified.

AB 516, as it passed the Assembly, authorized registered veterinary technicians and veterinary assistants to, among other things, perform animal health care services not otherwise prohibited by law on animals housed in public or private animal shelters, humane societies, or societies for the prevention of cruelty to animals pursuant to an order of a veterinarian. AB 516, as it passed the Assembly, authorized a registered veterinary technician to perform dental care procedures, including tooth extractions, under the supervision of a veterinarian.

The Senate amendments make a nonsubstantive change and add coauthors.

AB 574, as it passed the Assembly, prohibited a health care service plan contract or health insurance policy issued, amended, or renewed on or after January 1, 2027, that provides coverage for physical therapy from requiring prior authorization for the initial 12 treatment visits for physical therapy for a new episode of care. The Assembly version defined “new episode of care” for these purposes to mean treatment for a new or recurring condition for which the insured has not been treated by the provider within the previous 90 days and is not currently undergoing active treatment.

The Senate amendments instead prohibit requiring prior authorization for the initial 12 treatment visits for physical therapy for a new condition. For a recurring condition, the Senate amendments authorize a health care service plan or health insurer to impose prior authorization if the individual seeks care within 180 days of their last physical therapy intervention for that condition.

AB 671, as it passed the Assembly, created a streamlined approval process for tenant improvements of a restaurant by authorizing a licensed architect or engineer to act as a qualified professional certifier for purposes of certifying plans and specifications of the improvement and deeming an application for the improvement approved if the relevant department or agency does not approve or deny a permit within 20 business days of receiving a completed application.

The Senate amendments exclude fast food restaurants, as defined, from the definition of “restaurant” for these purposes and limit subsequent review of resubmitted applications to only those deficiencies identified by the department or agency in the initial denial.

The Senate amendments authorize a city or county to adopt additional requirements for qualified professional certifiers, including local training and registration requirements, and the assessment of fees and the imposition of penalties, as specified. The amendments grant immunity to a public entity and public employee from liability for any discretionary or ministerial act or omission relating to the issuance or denial of a permit, and require the applicant to indemnify the local agency from any property damage or personal injury arising from construction permitted pursuant to these provisions.

The Senate amendments authorize the applicable state licensing boards to suspend or revoke a license of a qualified professional certifier who makes a false statement in a certification pursuant to these provisions.

The Senate amendments add coauthors.

The Senate amendments renumber the code section that would be added by the bill.

AB 1150, as it passed the Assembly, revised existing restrictions and authorizations related to airport customer facility charges, which the bill defined as a fee required by an airport to be collected by a rental company from a renter for a specified purpose, including, among others, “to finance, design, construct, and perform maintenance on consolidated airport vehicle rental facilities.”

The Senate amendments revise this purpose within the definition of “customer facility charge” to instead apply to “major maintenance,” as provided.

AB 1213, as it passed the Assembly, required that a restitution order be paid before all fines, restitution fines, penalty assessments, and other fees.

AB 1369, as it passed the Assembly, extended a pupil’s authorization to wear an adornment, defined for these purposes as something attached to or worn with, but not replacing, the cap and gown customarily worn at school graduation ceremonies, to school events that are related to graduation and clarified that what constitutes traditional regalia or recognized objects of religious or cultural significance is to be determined by the pupil and the pupil’s family. AB 1369, as it passed the Assembly, prohibited a local educational agency from requiring (1) a preapproval process for a pupil to exercise their rights to wear an adornment and (2) a pupil to wear a cap if the cap is incompatible with the adornment.

The Senate amendments revise the definition of “adornment” as it relates to a cap customarily worn at school graduation ceremonies to instead mean something attached to, worth with, or worn in place of, the cap.
