AB 2320, as it passed the Assembly, for Homekey awards made on or after July 1, 2026, required the Department of Housing and Community Development to consider allowing applicants that utilize funds for adaptive reuse to be subject to the same timelines as new construction.

The Senate amendments instead require the department to consider allowing applicants that utilize funds for adaptive reuse to be subject to the same timelines as new construction if the adaptive reuse involves substantial rehabilitation, reconstruction, or demolition of an existing structure. The Senate amendments define “substantial rehabilitation, reconstruction, or demolition” for these purposes to include a project in which at least 55% of the existing structure is demolished, replaced, or substantially reconstructed.

AB 2415, as it passed the Assembly, authorized a transit-oriented development alternative plan to reduce the capacity in a transit-oriented development zone in total units or residential floor area by more than 50% if certain requirements are met.

AB 1933, as it passed the Assembly, required a county surveyor to return a nonconforming record of survey to the presenting licensed land surveyor or registered civil engineer with a written statement of the changes necessary to make it conform.

The Senate amendments instead require the county surveyor to return the nonconforming record to the presenting licensed land surveyor or licensed civil engineer.

AB 1933, as it passed the Assembly, made nonsubstantive changes in provisions that require a county surveyor or engineer to examine a submitted corner record for compliance with specified monument identification and tagging provisions.

The Senate amendments delete the authority of the county engineer to examine a corner record and make conforming changes.

AB 1807, as it passed the Assembly, required state agencies, on or before January 1, 2027, to develop procedures to require a state employee who becomes aware of an attempted or actual use of state-owned property for immigration enforcement purposes to document the incident and immediately report the incident to their supervisor, who was then required to immediately notify the Attorney General’s office or designee, as specified.

The Senate amendments instead require state agencies, on or before July 1, 2027, to develop procedures to ensure that an attempted or actual use of state-owned property for immigration enforcement purposes is documented in writing and that the Attorney General’s office or designee is notified, as specified. The Senate amendments provide various exceptions to the bill’s provisions.

AB 2194, as it passed the Assembly, required that the terms for members of the governing body to be staggered for the term beginning after January 1, 2027, and required that the alternate member from the Board of Supervisors have the same right of access as any other member.

The Senate amendments instead require that the terms for certain members of the governing body be staggered for the term beginning prior to January 1, 2027, remove the requirement that the alternate member from the Board of Supervisors have the same right of access as any other member, and require the governing body to authorize and pay for an independent external audit of its governance procedures and practices.

AB 2588, as it passed the Assembly, authorized the board of directors of a district agricultural association, if the Governor has not filled a vacancy on the board of directors within 90 days and the board of directors has insufficient membership to establish a quorum, to temporarily appoint a director to fill the vacancy and establish a quorum, as provided.

The Senate amendments make a nonsubstantive change to those provisions.

AB 1180, as it passed the Assembly, required the Department of Financial Protection and Innovation to adopt regulations to allow any payment made under the Digital Financial Assets Law (DFAL) to be made with digital financial assets and required the department to submit, on or before January 1, 2028, a report to the Legislature on those regulations, as specified. AB 1180, as it passed the Assembly, provided that its provisions would become operative on July 1, 2026, and be repealed on January 1, 2031.

The Senate amendments instead authorize the department to adopt regulations to allow specified payments under the DFAL to be made with stablecoins, as provided. The Senate amendments provide that these provisions become operative on July 1, 2027, and repeal the provisions on January 1, 2032.

AB 1632, as it passed the Assembly, removed the requirement that the submitted form for a request to a peace officer for assistance in dealing with a trespass be notarized.

The Senate amendments additionally require the request to include a written declaration, signed under penalty of perjury, that the requestor is the owner of the property and has legal authority to request the assistance, that the information provided in the request is true and correct, that the requestor acknowledges that law enforcement may rely on the declaration in taking enforcement action, and that the requestor is required to notify law enforcement if they no longer have legal authority over the property or if the request is withdrawn. The Senate amendments also authorize law enforcement to reasonably rely on the above-described declaration unless it has actual knowledge that the declaration is false.

AB 2168, as it passed the Assembly, revised the project eligibility and selection guidelines for the Active Transportation Program, including adding to the required project selection criteria recommendations to maximize commitments of state transportation improvement program funds to projects funded by the Active Transportation Program to scale funding for larger or network-level active transportation improvements.

The Senate amendments substitute for this provision a revision of an existing authorization, for including in the guidelines incentives for attracting other funds for active transportation projects, to make that authorization a requirement to include those incentives in order to scale funding for larger or network-level active transportation improvements. The Senate amendments make other changes to the selection criteria that the bill, as it passed the Assembly, revised, and add a requirement that a project applicant consult with the executive officer of a transit agency for certain projects.

AB 395, as it passed the Assembly, required, commencing with the 2026–27 school year, the governing board of a school district, a county office of education, or the governing body of a charter school to consider making efforts to avoid scheduling the first day of class and high school graduation, if applicable, on a date for which the governing board or the county office of education knows, or has reason to know, that members of the public would be unable to participate due to the ritual observance of a religious, cultural, or ancestral holiday. AB 395, as it passed the Assembly, also required the governing board or the county office of education, in considering which dates to avoid, to actively seek input from the affected community, as specified.

The Senate amendments would delay the required implementation of these provisions to the 2027–28 school year. The Senate amendments would clarify that the provisions relating to the knowledge of conflicting holidays and the required community input would also apply to the governing body of a charter school.

AB 395, as it passed the Assembly, required, commencing with the 2026–27 academic year, the governing board of a community college and the California State University to make every reasonable effort when developing their academic calendars to avoid calendaring an institutional event on a date for which the institution knows, or has reason to know, that members of the public would be unable to participate due to the ritual observance of a religious, cultural, or ancestral holiday. AB 395, as it passed the Assembly, requested that the University of California follow these same provisions.

The Senate amendments would delay the required implementation of these provisions to the 2027–28 academic year. The Senate amendments would instead require, and in the case of the University of California, request, that the institutions make good faith, reasonable efforts when developing their academic calendars to avoid the specified conflicts between institutional events and holidays. The Senate amendments would also authorize a person who has suffered harm as a result of a violation of these provisions to bring a civil action for injunctive relief, as provided.

AB 395, as it passed the Assembly, required state agencies to make every reasonable effort to avoid conducting any meeting, conference, or other function on a date for which the state agency knows, or has reason to know, that members of the public would be unable to participate due to the ritual observance of a religious, cultural, or ancestral holiday, as specified.

The Senate amendments would, instead, require that state agencies make good faith, reasonable efforts to avoid the specified conflicts between state agency functions and holidays. The Senate amendments would also authorize a person who has suffered harm as a result of a violation of these provisions to bring a civil action for injunctive relief, as provided.

AB 550, as it passed the Assembly, defined “at-risk species” and provided that if an at-risk species becomes listed as an endangered, threatened, or candidate species no further authorization or approval from the Department of Fish and Wildlife is required for take of that species if (1) the potential listing of the at-risk species was anticipated in a permit previously issued by the department, as provided, for an incidental take caused by a renewable electrical generation facility and (2) the take is in compliance with the department’s authorization to authorize, by permit, the take of an endangered, threatened, or candidate species if specified conditions are met, including, among others, that the impacts of the authorized take are minimized and fully mitigated. AB 550, as it passed the Assembly, also authorized the department, in partnership with the applicant of a take permit, to develop a research project that evaluated specified information and authorized research projects that are reviewed and approved by the department to contribute towards a renewable electrical generation project’s mitigation. AB 550, as it passed the Assembly, required the department to, on or before January 1, 2030, report on specified information to the Legislature, as provided.

The Senate amendments instead define “species proposed for listing” and allow the department to authorize, by permit, the take of a species proposed for listing if specified conditions are met. The Senate amendments substitute “species proposed for listing” for “at-risk species” and modify the above-described criteria under which no further authorization or approval from the department is required for take of a species proposed for listing that becomes listed as an endangered, threatened, or candidate species. The Senate amendments delete the research project provisions. The Senate amendments delete the requirement that the department report to the Legislature specified information and instead require the department to, on or before January 31, 2033, compile and post a summary table on its internet website that includes specified information for specified calendar years.

AB 643, as it passed the Assembly, authorized a local jurisdiction to count organic material used as a beneficial agricultural amendment towards its recovered organic waste procurement target under specified conditions.

The Senate amendments instead authorize a local jurisdiction to count organic material used as a beneficial agricultural amendment derived from organic waste processed with biosolids towards up to 10% of its recovered organic waste procurement target under specified conditions. The Senate amendments additionally revise the existing authority of a local jurisdiction to count compost produced and procured towards its recovered organic waste procurement target from compost operations composting green material, agricultural material, food material, and vegetative food material by replacing the current limit on the total amount of feedstock and compost onsite of 100 cubic yards and 750 square feet with a new limit of 200 cubic yards, or 500 cubic yards for a composing activity owned by a public agency, and authorize that amount to be increased by regulation, as specified.

AB 801, as it passed the Assembly, established the California Community Reinvestment Act and required, among other things, a covered financial institution, as defined, to have a continuing and affirmative obligation to meet the financial services needs of the communities, including low- and moderate-income communities and communities of color, in which the covered financial institution conducts substantial business, as specified.

The Senate amendments remove those provisions and instead require, under the Banking Law and the California Credit Union Law, the Commissioner of Financial Protection and Innovation to, at least once every 4 years, examine, as prescribed, the books and records of certain entities subject to the commissioner’s examination authority under those laws for compliance with any nondiscrimination law applicable to mortgage lending, as specified, and require the commissioner to provide a written statement of the findings of that examination, issue a copy of that statement to the subject’s principals, officers, or directors, and take appropriate steps to ensure correction of any violations of applicable nondiscrimination laws. The Senate amendments also, as part of a certain examination required by the California Residential Mortgage Lending Act, require the commissioner to additionally examine a licensee for compliance with any nondiscrimination law applicable to mortgage lending, as prescribed.

AB 1731, as it passed the Assembly, required the Office of Farm To Fork to establish the California Healthy Food Procurement Fund Program for purposes of cultivating equity, nurturing students, building climate resilience, supporting California agriculture, and creating scalable and sustainable change in the school food system. AB 1731, as it passed the Assembly, required the office to, among other things, and to the extent that funding is available, provide funding to approved vendors to procure only food products that are whole or are minimally processed and are grown or produced in California using climate-smart agriculture practices and climate-smart agriculture production systems.

The Senate amendments, among other things, instead require the office to establish the Healthy Food for California Public Institutions Program for the purpose of identifying vendors in California that have the capacity to provide healthy foods to California public institutions and require the office to develop a list of approved vendors that public institutions can use to procure food products that are whole or minimally processed and are grown or produced in California using climate-smart agriculture practices and climate-smart agriculture production systems.

AB 1761, as it passed the Assembly, required the Public Utilities Commission, among other things, to require an electrical corporation or other party, in submitting a proposal or analysis for the determination or application of a calculation methodology for any charge imposed on customers of a load-serving entity to recover costs associated with contracts, electrical corporation-owned generation, or any other resource or value included in that charge and any other charge derived from those costs, to make all data serving as a basis for that proposal or analysis available to load-serving entities and ratepayer advocates on behalf of customers.

The Senate amendments expand the above-described requirement to include a member association and load-serving entity in addition to an electrical corporation, and specify that the provisions apply to the calculation methodology for any nonbypassable charge, as specified. The Senate amendments also require that the data exclude any information that can reasonably be used to identify an individual, family, household, residence, or nonresidential customer.

AB 1918, as it passed the Assembly, modified provisions requiring certain businesses and establishments to post a notice relating to slavery and human trafficking and provide employee training on human trafficking to also require body art facilities to post that notice and provide that training. AB 1918, as it passed the Assembly, authorized the training to include evidence-based, trauma-informed curriculum developed by private, nonprofit organizations that represent the interests of human trafficking victims.

The Senate amendments further revise the training provisions, which included information and material utilized by the Department of Justice, to specifically reference information and material available on the Department of Justice’s internet website.

AB 2150, as it passed the Assembly, required an employer operating in this state that requires cardiopulmonary resuscitation (CPR) certification training of its employees to also require those employees to take an online video module training on the use of naloxone.

The Senate amendments do the following:

(1)Deem an employee who has completed CPR certification, first aid certification, or other training through a program that the Emergency Medical Services Authority determines includes training that meets or exceeds specified minimum standards to have satisfied this online training requirement.

(2)Authorize the Emergency Medical Services Authority to establish a process by which a training program, certifying body, or employer may seek a determination that an existing training meets or exceeds the standards.

(3)Prohibit an employer operating in this state that requires CPR certification training of its employees from being required to provide separate training to that employee, if the employer maintains documentation of the qualifying program or certification.

(4)Specify that this training requirement is for educational and preparedness purposes only and does not create an independent duty, authorization, or expectation for any employee to administer naloxone.
