The Senate amendments instead require the department to consider allowing applicants that utilize funds for adaptive reuse to be subject to the same timelines as new construction if the adaptive reuse involves substantial rehabilitation, reconstruction, or demolition of an existing structure. The Senate amendments define “substantial rehabilitation, reconstruction, or demolition” for these purposes to include a project in which at least 55% of the existing structure is demolished, replaced, or substantially reconstructed.

AB 713, as it passed the Assembly, prohibited the University of California, California State University, or California Community Colleges from disqualifying a student from being hired for an employment position due to the student’s failure to provide proof of federal work authorization, except where that proof is required by federal law or where that proof is required as a condition of a grant that funds the particular employment position for which the student applied. AB 713 required the University of California, the California State University, and the California Community Colleges to treat a specified prohibition in federal law on hiring undocumented noncitizens as inapplicable because that provision does not apply to any branch of state government.

The Senate amendments add coauthors.

AB 1845, as it passed the Assembly, among other things, required the governing board of a community college district, the Trustees of the California State University, the Regents of the University of California, and the governing boards of independent postsecondary educational institutions, in order to receive state funds for student financial assistance, to adopt a policy concerning incidents of human trafficking that involve students, faculty, or staff, and required this policy to include a statement that human trafficking is a violation of the student and employee code of conduct.

The Senate amendments require this policy to instead include a statement that a conviction of human trafficking by a criminal court is a violation of the student and employee code of conduct.

AB 2058, as it passed the Assembly, deleted the requirement on local enforcement agencies to enforce and inspect the installation of factory-built housing. The bill authorized the first user to choose between a local enforcement agency or a quality assurance agency to complete the inspection, prohibited the local agency from charging an inspection fee if the first user chooses a quality assurance agency, and prohibited local fees, including inspection fees, relating to factory-built housing from exceeding 50% of equivalent nonfactory-built housing fees.

The Senate amendments reinstate the requirement on local enforcement agencies to enforce installation of factory-built housing and require them to offer inspection. The amendments require the first user to cover costs of inspection if they choose a quality assurance agency and authorize a local enforcement agency to charge fees for inspection of items not related to the installation of factory-built housing even if a quality assurance agency performs the installation inspection. Notwithstanding the above-described 50% limit on local fees, the amendments authorize a local enforcement agency to exceed that limit if it provides substantial evidence of the reasonable costs, as specified. The amendments delay operation of the quality assurance agency inspection provisions until the Department of Housing and Community Development adopts regulations for that purpose and require the department to adopt those regulations by January 1, 2029.

AB 2080, as it passed the Assembly, required a county board of supervisors to set monthly or quarterly reporting requirements if the board delegated the authority to invest or reinvest public funds to the county treasurer.

The Senate amendments instead authorize that delegation if the county investment policy requires the county treasurer to make a monthly report of transactions to the legislative body and make a quarterly report, as provided.

The Senate amendments, among other things, additionally eliminate a 90-day time limit on conducting an annual audit with respect to pension funds received by the horsemen’s organizations, and also eliminate a deposit requirement to secure the payment of certain license fees, as specified.

AB 2439, as it passed the Assembly, required a common interest development association to notify the members by certified mail, return receipt requested, of a change of a person authorized to receive payment of assessments within 60 days.

The Senate amendments, instead, require a common interest development association to notify the members through individual notice by either electronic delivery or first-class mail, evidenced by a certificate of mailing, as specified, if the person or entity authorized to receive payment of assessments on behalf of the association changes. The Senate amendments require the association to send a 2nd notice by certified mail with return receipt requested if after sending an individual notice, a member has failed to pay 2 consecutive assessment payments, unless the member affirmatively responded to the individual notice. The Senate amendments require the association to maintain records confirming that individual notices were distributed and to make reasonable effort to post a physical copy of the notice in the association’s common areas.

AB 2439, as it passed the Assembly, made the board liable to the owner of a separate interest for a civil penalty of $1,000 if the association fails to comply with specified procedures before recording a lien on a member’s separate interest.

The Senate amendments, instead, make the association liable to the owner of a separate interest for this civil penalty if the association fails to comply with specified procedures before recording a lien on a member’s separate interest and the failure is the 3rd failure within a 5-year period. The Senate amendments require the association to notify members of the imposition of this penalty by general notice.
