AB 2320, as it passed the Assembly, for Homekey awards made on or after July 1, 2026, required the Department of Housing and Community Development to consider allowing applicants that utilize funds for adaptive reuse to be subject to the same timelines as new construction.

The Senate amendments instead require the department to consider allowing applicants that utilize funds for adaptive reuse to be subject to the same timelines as new construction if the adaptive reuse involves substantial rehabilitation, reconstruction, or demolition of an existing structure. The Senate amendments define “substantial rehabilitation, reconstruction, or demolition” for these purposes to include a project in which at least 55% of the existing structure is demolished, replaced, or substantially reconstructed.

AB 2415, as it passed the Assembly, authorized a transit-oriented development alternative plan to reduce the capacity in a transit-oriented development zone in total units or residential floor area by more than 50% if certain requirements are met.

The Senate amendments make nonsubstantive changes to incorporate additional changes to Section 65912.161 of the Government Code proposed by AB 2576 to be operative only if AB 2415 and AB 2576 are enacted and AB 2415 is enacted last.

AB 1933, as it passed the Assembly, required a county surveyor to return a nonconforming record of survey to the presenting licensed land surveyor or registered civil engineer with a written statement of the changes necessary to make it conform.

The Senate amendments instead require the county surveyor to return the nonconforming record to the presenting licensed land surveyor or licensed civil engineer.

AB 1933, as it passed the Assembly, made nonsubstantive changes in provisions that require a county surveyor or engineer to examine a submitted corner record for compliance with specified monument identification and tagging provisions.

The Senate amendments delete the authority of the county engineer to examine a corner record and make conforming changes.

AB 2588, as it passed the Assembly, authorized the board of directors of a district agricultural association, if the Governor has not filled a vacancy on the board of directors within 90 days and the board of directors has insufficient membership to establish a quorum, to temporarily appoint a director to fill the vacancy and establish a quorum, as provided.

The Senate amendments make a nonsubstantive change to those provisions.

AB 1632, as it passed the Assembly, removed the requirement that the submitted form for a request to a peace officer for assistance in dealing with a trespass be notarized.

The Senate amendments additionally require the request to include a written declaration, signed under penalty of perjury, that the requestor is the owner of the property and has legal authority to request the assistance, that the information provided in the request is true and correct, that the requestor acknowledges that law enforcement may rely on the declaration in taking enforcement action, and that the requestor is required to notify law enforcement if they no longer have legal authority over the property or if the request is withdrawn. The Senate amendments also authorize law enforcement to reasonably rely on the above-described declaration unless it has actual knowledge that the declaration is false.

AB 2280, as it passed the Assembly, authorized a repossession agency to file a lien on behalf of the repossession agency if a lien is currently in place and the lienholder affirmatively waives the right to the lien in writing or does not respond to a request for waiver made by certified mail.

The Senate amendments delete the provision specifying that the mailing of the request for waiver be achieved through certified mail.

AB 1184, as it passed the Assembly, among other things, required the board of directors of an association managing a common interest development, if the association becomes involved in litigation, to provide notice of the occurrence as part of the annual budget report distributed to members, as provided, authorized a member receiving the notice to request the name of the court and case number of any litigation, required discussions regarding ongoing litigation to have the case name included as part of the executive session meeting minutes, required notice to be given at the beginning of every open session of the board that the meeting is being recorded, exempted an election to amend the operating rules from a requirement that certain elections be held by secret ballot, and limited the costs and fees that a court is required to award if it finds that an association unreasonably withheld access to association records, as provided.

The Senate amendments, instead, require discussions regarding ongoing litigation to have the case name, case number, and name of the court included as part of the executive session meeting minutes, require the notice of recording to be given only for meetings that are recorded, authorize a recording used solely for creating meeting minutes to be deleted 12 months after the draft minutes are completed, require the board to make a physical copy of the minutes of a board meeting available to a member who requests a physical copy, as provided, require the minutes of a board meeting to include how each director voted on any amendment, adoption, or repeal of an operating rule, require the association’s annual budget report to also include a statement listing any active litigation in which the association is named as a party, as specified, and recast provisions related to informational or ministerial communications between members of the board of directors.

AB 1128, as it passed the Assembly, contingent upon an appropriation of one-time funding by the Legislature, established the California Student Teacher Support Grant Program, under the administration of the Commission on Teacher Credentialing, to compensate teaching credential candidates while they perform required student teaching.

The Senate amendments delete the contents of AB 1128 and instead revise provisions governing the amount that management of a mobilehome park may increase rent by. Specifically, the Senate amendments extend a specified rent increase cap applicable to a mobilehome park that is located within and governed by the jurisdictions of 2 or more incorporated cities until January 1, 2036. The Senate amendments also apply a similar rent increase cap to a mobilehome park located in the City of Torrance, as specified, until January 1, 2036. The Senate amendments make legislative findings and declarations as to the necessity of a special statute for the City of Torrance.

AB 2080, as it passed the Assembly, required a county board of supervisors to set monthly or quarterly reporting requirements if the board delegated the authority to invest or reinvest public funds to the county treasurer.

The Senate amendments instead authorize that delegation if the county investment policy requires the county treasurer to make a monthly report of transactions to the legislative body and make a quarterly report, as provided.

AB 502, as it passed the Assembly, required certain notices, affidavits, and communications regarding elections to be delivered by certified mail or, for certain communications between local officials and the Secretary of State, by electronic delivery.

The Senate amendments delete the content passed by the Assembly and instead would: 1) prohibit the distribution of materially deceptive content that is material to a voter’s electoral decisions or to public confidence in an election’s process or outcome, as specified; and, 2) impose additional requirements regarding the color and font size of an advertisement or communication, authorize an individual depicted in the advertisement or communication to bring an action for an injunction or damages, and exempt an advertisement or communication from these requirements if a reasonable person would understand that the content was satire or parody or if the content includes a disclosure, as specified. The Senate amendments would also declare that the bill will take effect immediately as an urgency statute.

AB 686, as it passed the Assembly, prohibited specified individuals appointed by the Governor to the Department of Cannabis Control and the Cannabis Control Appeals Panel from engaging in certain activities, including from receiving any commission or profit whatsoever, directly or indirectly, from any person applying for or receiving any license or permit.

The Senate amendments delete those provisions and instead extend the repeal dates of statutes relating to the use of deceptive audio or video media in elections.

AB 1130, as it passed the Assembly, revised the removal authority of an appointing power of the Medical Board of California to authorize the removal of a member of the board appointed by that authority for continued neglect of duties required by law, or for incompetence, or unprofessional or dishonorable conduct.

The Senate Amendments delete the contents of AB 1130 and instead amend provisions of the Political Reform Act of 1974 that require a person paid by a committee to post online or digital content for the purpose of supporting or opposing a candidate for elective office or a ballot measure to include a disclaimer stating that they were paid by the committee in connection with the posting. Specifically, the Senate amendments subject a person who does not include this disclaimer to joint and several liability for any civil or administrative penalties incurred for the violation, require the committee to inform the person of potential penalties, and require the committee to include a statement on their campaign report, as specified, that the payment was provided for a paid thirty-party post.

AB 605, as it passed the Assembly, enacted the Lower Emissions Cargo Handling Equipment Pilot program to prohibit the State Air Resources Board from adopting a future regulation that would prohibit or restrict the use of any cargo handling equipment, as defined, purchased pursuant to the pilot program before December 31, 2027.

The Senate amendments delete those provisions and, instead, establish the Refinery Safe Staffing Task Force to develop potential methods and strategies for ensuring maximum employee retention at refineries during, and especially in the time period preceding, a refinery closure or long-term idling, and addressing employment dislocations associated with oil, gas, and related industries.

The Senate amendments require the task force, no later than June 1, 2029, to present to the Legislature and make available online to the public a report that documents a wide range of potential methods and strategies for ensuring maximum employee retention in the time period preceding refinery closure or long-term idling of a refinery, for ensuring safe operation in the event of understaffing, and for transitioning oil and gas workers into sectors that match their skills and experience. The Senate amendments include related legislative findings and declarations.

The Senate amendments make these provisions inoperative on July 1, 2029 and repeal them on January 1, 2030.

AB 2179, as it passed the Assembly, provided that, beginning on July 1, 2027, any party or witness to a petition for a restraining order brought by an employer or authorized bargaining representative on behalf of an employee who suffered unlawful violence or a threat of unlawful violence may appear remotely at a hearing. As it passed the Assembly, it also required courts to allow filings related to such protective orders to be submitted electronically starting July 1, 2027.

The Senate Amendments push back the dates for remote participation and electronic filing in such cases to January 1, 2028. The Senate amendments also require the Judicial Council to develop the necessary forms to implement remote participation and electronic filing by January 1, 2028.

AB 2433, as it passed the Assembly, among other things, defined the term “moderate-income household” for purposes of the Density Bonus Law and specified that this definition includes lower income households, very low income households, and extremely low income households, as defined.

The Senate amendments no longer provide that, for purposes of the Density Bonus Law, the definition of moderate-income household includes lower income households, very low income households, and extremely low income households, as defined.

AB 2433, as it passed the Assembly, revised and recast the provisions related to permitting of a density bonus relative to the geographic area to instead require a density bonus, incentive, or concession, or waiver or reduction, on sites that are the subject of the same housing development, as specified.

The Senate amendments additionally allow an applicant who provides a base density study, as defined, to elect to receive a density bonus in the form of a percentage increase in maximum floor area ratio, as specified. The Senate amendments create an additional exception to the requirement that base density be determined using dwelling units per acre for applicants who elect to provide a base density study.

AB 2433, as it passed the Assembly, required a housing development project that satisfies the requirements related to a California Environmental Quality Act exemption, as specified, and is eligible for a density bonus, incentives or concessions, and waivers or reductions of development standards for purposes of the Density Bonus Law and meets other affordability requirements, to be a use by right and subject to ministerial review.

The Senate amendments no longer require a housing development project, as described above, to be a use by right and subject to ministerial review.

The Senate amendments also make nonsubstantive triple-jointing amendments to resolve conflicts with AB 2480 and SB 1383.

AB 2562, as it passed the Assembly, required a facility licensed by the State Department of Health Care Services to develop a suicide prevention plan and required the department to promulgate regulations to implement this provision, as specified.

The Senate amendments update Section 11834.26 of the Health and Safety Code to include the latest amended form of that section as a result of the enactment of SB 164, which took effect immediately.

AB 2633, as it passed the Assembly, made various revisions to provisions relating to a uniform, statewide, state-administered program of regulation of persons whose principal business is buying, selling, trading, auctioning, or taking in pawn tangible personal property, as defined.

The Senate amendments remove the term “principal” from certain findings and declarations provisions describing that program. The Senate amendments also make those provisions governing those tangible personal property transactions inapplicable to tangible personal property that has been acquired from a nonprofit organization or as a bulk purchase of donated items. The Senate amendments also reiterate that any person conducting business as a secondhand dealer is required to report secondhand tangible personal property that they acquire to the California Pawn and SecondhandDealer System (CAPSS).

AB 2633, as it passed the Assembly, expanded the definition of “tangible personal property” to include secondhand jewelry, items, or objects.

The Senate amendments remove that expansion. The Senate amendments, instead, revise provisions that defines “tangible personal property” to include all tangible personal property that the Attorney General statistically determines through the most recent Department of Justice crime data, as specified, to constitute a significant class of stolen goods. Specifically, the Senate amendments delete a provision that defines “significant class of stolen goods” to mean those items determined through the Department of Justice’s most recent OpenJustice Web portal update to constitute more than 10% of property reported stolen in the calendar year preceding the annual posting of the list of significant classes of stolen goods.

The Senate amendments expand the definition of “secondhand dealer” for purpose of the provisions governing tangible personal property transactions by removing certain participants at gun events from a provision that otherwise excludes them from that definition.

AB 2689, as it passed the Assembly, specified that for purposes of certain housing projects participating in the low-income housing tax credit program, good cause for nonrenewal of a lease includes cases where, among other things, 30% of the household’s monthly income exceeds the fair market rent for the county where the unit is located.

The Senate amendments revise the above-described threshold for good cause for nonrenewal to cases where 30% of the household’s monthly income exceeds the greater of the United States Department of Housing and Urban Development’s Fair Market Rent for an equivalent-sized unit for the county where the unit is located, as updated annually, and the United States Department of Housing and Urban Development’s Small Area Fair Market Rent for an equivalent-sized unit for the ZIP Code where the unit is located, as updated annually.
